Terms & Conditions (Digital Products)

1. General
These Terms & Conditions (“Terms”) apply to all purchases of digital products (such as templates, courses, and other downloadable content) from Chantal Spatzier, Sonnleiten 342/12, 2754 Wopfing-Waldegg, Austria (“we,” “us,” or “our”), via our online shop on ThriveCart.

By completing a purchase, you (“customer,” “you”) agree to these Terms.

2. Digital Products & Access
Upon successful payment, you will receive immediate access to the purchased digital product(s). Products are delivered electronically via the email address you provided during checkout or through a direct download link.

Please ensure that your email address is entered correctly, as we are not responsible for failed deliveries due to incorrect information provided by you.

3. No Right of Withdrawal
According to EU law (Directive 2011/83/EU, implemented in §18 FAGG), the right of withdrawal does not apply to digital content once you have begun downloading or accessing it, provided you have expressly agreed to waive your right of withdrawal.
By purchasing, you confirm that you lose your right of withdrawal as soon as you gain access to the digital product.

4. Licensing & Usage
All products are for personal and/or business use only by the purchasing customer.
Reselling, distributing, sharing, or transferring the digital product to third parties is strictly prohibited.

For templates, you may use them to create end products for your own projects or your clients (if explicitly stated), but you may not resell the template itself or claim it as your own design.

5. Pricing & Payment
All prices are stated in Euros (EUR) and include VAT where applicable.
Payment is processed securely through our payment provider (ThriveCart), and access to the product is granted once payment has been received in full.

6. Refund Policy
As these are digital products, all sales are final.
We do not offer refunds or exchanges once the product has been delivered, except where required by law. Please review product descriptions carefully before purchasing.

7. Limitation of Liability
We are not liable for any damages resulting from the use or inability to use our digital products, except in cases of intentional misconduct or gross negligence.
You are responsible for ensuring that any templates, designs, or materials meet your technical requirements and are compatible with your software.

8. Intellectual Property
All content, including but not limited to text, graphics, designs, and templates, remains the intellectual property of Chantal Spatzier.
Unauthorized reproduction, resale, or distribution is strictly prohibited and may lead to legal action.

9. Governing Law
These Terms are governed by the laws of Austria. Any disputes arising shall be subject to the jurisdiction of the competent courts in Wiener Neustadt, Austria.
